1. Definitions
"Service" means the WhaleWatchR dashboards, APIs, datasets, and support channels provided by WhaleWatchR. "User" refers to any natural or legal person who creates an account or accesses the Service. "Content" includes insights, charts, exports, and alerts produced through WhaleWatchR.
2. Scope of Service
WhaleWatchR delivers blockchain analysis tooling. Features, plan limits, and beta functionality may evolve. We may roll out experimental modules that can be suspended or changed without prior notice.
3. No Financial Advice
All output is informational only. WhaleWatchR does not provide investment, legal, accounting, or tax advice. Users remain solely responsible for due diligence and compliance with applicable regulations.
4. Accuracy & Availability
We strive for high data quality yet cannot guarantee completeness, timeliness, or accuracy of on-chain or third-party data sources. Temporary downtime may occur due to maintenance or upstream outages affecting WhaleWatchR.
5. Acceptable Use
- No reverse engineering, automated scraping beyond documented limits, or interference with system stability.
- No sharing of credentials or reselling of dashboards without written consent.
- No usage that violates sanctions, AML requirements, or other applicable laws.
- No uploading of malicious code or exploiting infrastructure vulnerabilities.
6. Liability
We exclude liability for slightly negligent breaches except for injury to life, body, or health. For paid plans, aggregate liability is capped at the fees paid in the preceding 12 months. Mandatory statutory warranties remain unaffected.
7. Suspension & Termination
We may suspend or terminate accounts for policy violations, detected fraud, or overdue invoices. You may terminate anytime via the billing portal; refunds are only issued where required by law.
8. Governing Law
These Terms are governed by German law. Exclusive jurisdiction lies with the competent courts in Bad Oeynhausen, unless mandatory consumer protection rules prescribe a different venue.
